2. Assembly Minds engineering continuously monitors error rates, token latency, and execution reliability via secure, non-PII telemetry dashboards.
3. Both parties log operational metrics to quantify exact hours saved and lead capture efficiency.

04. Measurable KPI Benchmarks Objective Metrics

To ensure objective evaluation free from subjective ambiguity, the Performance Guarantee is tied to three verifiable data points established during your initial discovery audit:

05. Client Cooperation & Asset Provision Prerequisites

High-performance automated systems require seamless integration into your existing business infrastructure. For the 14-Day Turnkey Delivery Protocol and 100% Performance Guarantee to remain active, the Client agrees to the following cooperative standards:

• 3-Day Credential & Asset Provision: The Client must provide all required third-party API credentials, webhook access permissions, knowledge base documents, and CRM access within three (3) business days of kickoff.
• Technical Continuity: The Client agrees not to unilaterally modify webhook URLs, alter database field schemas, revoke API keys, or disable telephony forwarding without prior consultation with Assembly Minds engineers during the 30-day evaluation.
• Active Telephony Routing: The Client must maintain normal inbound call and lead traffic routing through the deployed system so statistically significant operational data can be collected.

Note: Failure to supply required access within the 3-day window or intentional disabling of system routing pauses the 14-day delivery timeline and evaluation period until access is reinstated.

06. 14-Day Optimization & Cure Window Remediation

In the unlikely event that your system does not meet the specified KPI benchmarks by the end of the 30-day evaluation period, we do not simply walk away—we mobilize our engineering staff to cure the deficiency.

1. Written Notice: The Client submits a written performance notification via email to [email protected] within five (5) business days following the end of the 30-day evaluation window, detailing observed shortfalls.
2. The 14-Day Cure Window: Upon receipt, Assembly Minds activates a dedicated 14-calendar-day Optimization & Cure Window. Our senior engineers perform comprehensive trace audits, refine prompt logic, retrain vector models, and optimize pipeline bottlenecks at zero additional expense to you.
3. Final Validation: If following the 14-day cure window the system still fails to achieve the measurable KPI benchmarks, your full refund is immediately approved and executed.

07. Refund Execution & Stripe Payout Process Payout Protocol

When a refund is approved under this Performance Guarantee, we execute the payout with total efficiency and zero friction:

• 100% Remittance: Assembly Minds refunds 100% of all professional engineering and implementation fees paid for the engagement.
• Direct Stripe Reversal: The refund is executed through Stripe directly back to the original funding source (credit card, debit card, or ACH transfer) on file.
• Payout Speed: The Stripe transaction is initiated within twenty-four (24) hours of guarantee approval. Standard banking settlement times range from 5 to 10 business days depending on your financial institution.
• Graceful Transition: Upon execution of the refund, operational access is respectfully decommissioned, intellectual property rights to proprietary internal models revert, and both parties are released from further contractual obligations under the build agreement.

08. Excluded Third-Party Infrastructure Fees Pass-Through Costs

To maintain complete transparency, the 100% Money-Back Guarantee applies specifically to all professional services, custom code architecture, prompt engineering, integration development, and agency setup fees billed by Assembly Minds.

The guarantee does not apply to metered usage fees paid directly by the Client to third-party infrastructure providers. These third-party pass-through expenses include, but are not limited to:

• Model inference API token usage (e.g. OpenAI, Anthropic, Deepgram, ElevenLabs speech synthesis).
• Independent cloud hosting, VPS, or automation runtime subscriptions (e.g. Make.com, Zapier, Supabase, AWS, Cloudflare).

These direct infrastructure costs are billed directly to your corporate payment cards by respective vendors and are strictly non-refundable by Assembly Minds.
